Welcome to Lone Star Telemedicine, LLC (“we,” “us,” “our,” or “Company”). These Terms and Conditions (“Terms”) govern your use of our website, services, and platform (collectively, the “Service”). 2. Services Provided

  • Lone Star Telemedicine provides a platform to connect users with licensed medical providers for telemedicine consultations.
  • Lone Star Telemedicine itself does not practice medicine, provide medical care, or issue prescriptions.
  • All medical services are provided by independent, licensed physicians or medical providers who operate under a Management Services Agreement (MSA) with Lone Star Telemedicine.

3. Eligibility

  • Users must be at least 12 years of age to use the Service.
  • Users under the age of 18 must have parental or legal guardian consent.
  • The Service is available only to residents of Texas.

4. User Responsibilities

  • Users must provide accurate, complete, and truthful information when creating an account and during consultations.
  • Users are responsible for maintaining the confidentiality of their account credentials and all activities conducted under their account.
  • Users agree not to use the Service for emergencies or life-threatening conditions.

5. Privacy and Data Handling

  • Lone Star Telemedicine complies with HIPAA regulations to ensure the confidentiality and security of your personal and health information.

6. Payment and Cancellation Policy

  • Payments for consultations are required upfront.
  • Refunds will not be issued once a consultation has been completed.
  • Cancellations made prior to a scheduled consultation may be eligible for a refund, provided the cancellation request is submitted at least 24 hours in advance.
  • Technical issues caused by the platform that result in a failed consultation may be eligible for refunds or rescheduling on a case-by-case basis.

7. Prohibited Activities

Users agree not to:

  • Provide false or misleading information during consultations.
  • Use the Service to obtain controlled substances or prescriptions unlawfully.
  • Harass, threaten, or abuse our staff or medical providers.
  • Attempt to hack, disrupt, or interfere with the platform.
  • Use the Service for illegal purposes.

8. Liability Limitations

  • Lone Star Telemedicine provides the platform to facilitate telemedicine services and does not assume medical liability.
  • All medical liability rests with the independent physician group providing the services.
  • Lone Star Telemedicine is not responsible for medical outcomes, misdiagnoses, or issues related to prescribed medications.
  • THE SITE AND ALL CONTENT THEREON IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, LONE STAR TELEMEDICINE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY AS TO THE OPERATION OF THE SITE OR THE CONTENT, THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, AND THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. LONE STAR TELEMEDICINE DOES NOT GUARANTEE THAT THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SITE WILL BE EFFECTIVE, RELIABLE, OR ACCURATE OR WILL MEET YOUR REQUIREMENTS. 9. Dispute Resolution

All disputes arising out of or related to the use of our Service shall be resolved as follows:

a. Mediation

  • In the event of a dispute, both parties agree to first attempt to resolve the issue through mediation conducted by a mutually agreed-upon neutral mediator.
  • Each party will share the cost of mediation equally.

b. Arbitration

  • If mediation fails, the dispute shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA).
  • The arbitration shall take place in Texas and be conducted in English.
  • The arbitrator’s decision will be final and binding, and judgment on the award may be entered in any court having jurisdiction.

10. Copyright and Trademarks

  • All content provided on the Service is the copyright of Lone Star Telemedicine or its content suppliers and is protected by U.S. and international copyright laws.
  • Users may print, download, or store information from the Service for personal, non-commercial use only.
  • The Lone Star Telemedicine name and logo are trademarks of Lone Star Telemedicine, LLC. Any unauthorized use of these trademarks is prohibited.

11. Changes to Terms and Conditions

  • We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting to the website.

  • These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.
